PRACTICE AREAS - Bankruptcy

Well known and respected in Bankruptcy Courts throughout Alabama and Tennessee, the members of the Bankruptcy and Creditors' Rights Section of Yearout, Spina & Lavelle have extensive experience in all matters involving secured and unsecured creditors. Our attorneys are specialists in guiding lenders through the highly technical and sometimes treacherous bankruptcy world. This requires specialized knowledge of all aspects of the Bankruptcy Code, as well as a refined understanding of the idealological, philosophical, and sometimes emotional background of each specific judge. All these are factors in the advice we provide to our clients.

We serve as the sole statewide representative for our lending clients and handle cases from our office directly. We do not refer cases to local counsel, which guarantees, when you hire Yearout, Spina & Lavelle, it is our attorneys who represent your interest, rather than local counsel unknown to you.

Thanks to the benefit of long-standing professional relationships with many debtors' attorneys throughout the state, we can resolve most matters quickly and affordably. When litigation becomes a necessity, our attorneys are experienced in litigating contested confirmation proceedings, evaluation disputes, adequate protection, and automatic stay litigation, preferences and fraudulent transfers, non-dischargeability actions, set-off and recoupment proceedings.
